It applies to brikly.au and to our buyer's agency services.
1. Information we collect
Depending on how you interact with us, we may collect:
- Contact details: name, email address, phone number, postal address.
- Account information: if you sign in to the off-market vault, we receive your name and email address from Google (if you use Google sign-in) or verify your email address directly (if you use email sign-in).
- Enquiry and brief details: your budget, target locations, investment strategy, timeframes and any other information you give us to source or assess a property.
- Financial information: information you choose to share about your borrowing capacity, finance pre-approval or (where relevant) SMSF structure, to the extent you volunteer it for us to act on your brief. We do not ask you to send full financial account numbers or passwords.
- Payment details: if you engage our services, payment is processed by a third-party payment provider. We do not store full card numbers.
- Technical and usage information: IP address, browser and device type, pages viewed and referring pages, collected automatically through cookies and similar technologies.
2. How we collect it
- Directly from you, through our contact forms, strategy calls, email, phone, or when you sign in to the off-market vault.
- Automatically, through cookies and analytics tools when you browse our website.
- From third parties where reasonably necessary, such as a selling agent or your financial or legal adviser, but only with your knowledge or authority.
3. How we use it
- To provide buyer's agency services: sourcing, assessing and negotiating on properties that match your brief.
- To respond to enquiries and manage your account and engagement with us.
- To process payments under our fee structure.
- To send you service-related communications and, where you have not opted out, updates about off-market properties or our services.
- To maintain, secure and improve our website.
- To meet our legal, regulatory and accounting obligations.
4. Who we disclose it to
We disclose personal information only where reasonably necessary, including to:
- Selling agents and vendors, to the extent needed to make or progress an offer on your behalf.
- Our service providers: website hosting, database and authentication infrastructure, email delivery, and payment processing.
- Your own professional advisers (conveyancer, mortgage broker, accountant), at your direction.
- A regulator, court, or government body where we are required to by law.
- A prospective buyer of our business, in the event of a sale, merger or restructure, subject to confidentiality.
We do not sell personal information, and we do not accept payment from third parties to disclose it.
5. Overseas disclosure
Some of our service providers may store or process information outside Australia — for example, our website hosting and authentication providers may process data through infrastructure located overseas (including the United States). Our primary database is hosted in Australia. Where personal information is handled overseas, we take reasonable steps to ensure it is held securely and consistent with the APPs.
7. Data security
We take reasonable technical and organisational steps to protect the personal information we hold from misuse, interference, loss, unauthorised access, modification or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Retention
We keep personal information only for as long as we reasonably need it for the purposes it was collected, or as required by law (for example, financial record-keeping obligations), after which we take reasonable steps to destroy or de-identify it.
9. Access and correction
You can ask us for access to the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will respond within a reasonable period and may need to verify your identity first. There is no charge for making a request, though we may charge a reasonable fee to cover the cost of giving you access in some cases.
10. Direct marketing
We may send you information about off-market properties or our services. You can opt out at any time by using the unsubscribe link in any email, or by contacting us directly — we will not use your information for direct marketing after you opt out.
11. Children's privacy
Our services are intended for adults (18 and over) engaging in property transactions. We do not knowingly collect personal information from children.
12. Data breaches
If a data breach occurs that is likely to result in serious harm, we will take steps consistent with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.
13. Complaints
If you have a concern about how we have handled your personal information, contact us first using the details below and we will investigate and aim to respond within 30 days. If you are not satisfied with our response, you can lodge a complaint with the OAIC:
